MEMORANDUM OF TENTATIVE AGREEMENT BETWEEN CALIFORNIA SCHOOL EMPLOYEES ASSOCIATION CHAPTER 559 AND EMERY UNIFIED SCHOOL DISTRICT
- I) PURPOSE OF MEMORANDUM
- A) This memorandum describes the terms to which the California School Employees Association, Chapter 559, (hereinafter CSEA) and the Emery Unified School District (hereinafter EUSD) mutually agree in order to reach a settlement on a new collective bargaining agreement which will extend until June 30, 2009.
- II) TERMS
- A) The parties agree to a one year settlement covering the period from July 1, 2005 to June 30, 2006. The EUSD will make a one time supplemental payment to every employee of record for the 05-06 school year at the rate of $1,000.00 per full time equivalent.
- B) The parties agree to a new three year contract to cover the period from July 1, 2006 to June 30, 2009. (Revise Article XXVI accordingly.)
- 1) There will be a 3% increase on the CSEA Salary Scale on July 1, 2006. There will be a 2% increase on the CSEA Salary Scale on July 1, 2007. There will be a 2% increase on the CSEA Salary Scale on July 1, 2008. (Revise Article XXI, Salary, accordingly.)
- 2) Starting July 1, 2008, all employees will contribute 0.75% of their gross salary, not to exceed $500 per year, towards the cost of the Health and Welfare package, which will otherwise remain the same as under the expired contract. (Revise Article XXII accordingly.)
- 3) The following Articles to the expired Collective Bargaining Agreement will be updated:
- (a) Article II – Recognition (as per attached)
- (b) Article XI, Paragraph B – Evaluation. The probationary period is changed from 6 months to 9 months and interim evaluation schedule is changed to 3 and 7 months.
- (c) Article XIV, Paragraph A (4) – Sick Leave. The authority to request proof of illness is changed from the District to the Superintendent.
- (d) Article XVII, Paragraph B&C. Working Out of Classification. The period of time working out of classification required to be eligible for a higher rate of pay is changed from 5 days to the majority of one day.
- 4) The following Appendices will be updated
- (a) Appendix A – Classified Salary Schedule (as per attached)
- (b) Appendix B – Classified Position and Pay Ranges (as per attached)
- (c) Appendix C – Evaluation Form (as per attached)
- 5) With respect to Article XXIV, Professional Growth, the parties agree to continue their joint efforts to create a professional growth program which will incentivize CSEA members to continue their education and professional development.
- C) The parties agree that the following conditions shall give cause to reopen the salary and/or benefits portions of the one year or three year agreements:
- 1) A settlement with another employee organization which contains higher compensation or a different health care package.
- 2) A written notice at any time during the three year agreement by either party to the other party that significant new revenues are available beyond what was anticipated at the time this agreement was signed.
